Terms of service

Overview

By booking a session with Merlot Visuals, you agree to the following Terms of Service. These terms apply to all photography and videography services, including Lifestyle Sessions, Brand Visuals, and Creative Visuals.

Booking Agreement

All bookings require a non-refundable retainer to secure a date. A booking is not confirmed until the retainer is received and a confirmation is issued.

Merlot Visuals reserves the right to decline or cancel any booking at its discretion.

Payments

Clients are responsible for paying all fees associated with their selected service.

  • Retainers are non-refundable under all circumstances
  • Remaining balances are due prior to or on the day of the session unless otherwise agreed
  • Failure to complete payment may result in cancellation of deliverables

Deliverables

Final deliverables will be provided based on the selected package.

  • Delivery timelines are estimates and may vary based on workload or project scope
  • RAW files are not included unless explicitly agreed in writing
  • All final edits reflect Merlot Visuals’ creative style and direction

Cancellations & Rescheduling

Clients may reschedule once with at least 48 hours’ notice.

Late cancellations or no-shows will result in forfeiture of the retainer.

Repeated rescheduling requests may require a new booking fee.

Creative Control

Merlot Visuals maintains full creative discretion over shooting style, editing, color grading, and final output.

Client preferences are considered, but final artistic decisions remain with Merlot Visuals.

Usage Rights

Unless otherwise agreed in writing, Merlot Visuals retains the right to use all delivered work for portfolio, marketing, social media, and promotional purposes.

Clients may request private sessions prior to booking.

Limitation of Liability

Merlot Visuals is not responsible for:

  • Injuries or accidents occurring during sessions
  • Loss of personal items during shoots
  • External factors affecting shoot quality (weather, lighting, location restrictions, etc.)

Changes to Terms

Merlot Visuals reserves the right to update these Terms of Service at any time without prior notice.
